Terms of Service
Effective: [date these terms take effect]
These terms are the agreement between you and us when you use Site Hustle. Please read them. By creating an account, you agree to them and to our Privacy Policy.
1. Who we are
Site Hustle is a service of Responsiv Agency (“we”, “us”), a business registered in New Jersey. Our address is 712 West Ave, Ocean City, NJ 08226, and you can reach us at [support email].
2. Who can use Site Hustle
- You must be at least 18 years old.
- Site Hustle is a tool for running a web design business. You use it as a business, not as a consumer.
- Keep your account details accurate and your password private. You're responsible for what happens in your account.
3. What Site Hustle does
Site Hustle helps you find local businesses, build sample websites for them with AI, write your pitch, follow up, and publish sites for the businesses that hire you. We may add, change or remove features over time.
Site Hustle never contacts businesses for you. It writes pitches and follow-ups, but you decide whether to send them, and you send them yourself.
4. Memberships and payment
- Most features need a paid membership. Your plan's price, and the monthly charge for each live site beyond what your plan includes, are shown on the Billing page before you pay.
- Memberships renew every month, and you're charged automatically until you cancel.
- There's no free trial. Without a membership you can try a few features, such as Lead Finder and one sample site; these may change.
- Payments are handled by Stripe. We never see or store your card number.
- Prices don't include taxes, which are added where required.
- If a payment fails, your membership ends until it's paid (see section 6).
- We'll tell you at least 30 days before a price change applies to you.
5. Refunds
- Memberships: if something isn't right, contact us at [support email] and tell us what happened. We look at every membership refund request and decide case by case.
- AI video credits aren't refundable once bought. If an AI video fails to make, the credit goes back to you automatically, and a result you don't like can be made again once for free.
6. Cancelling, and what happens to live sites
- To cancel your membership or close your account, contact us at [support email].
- When your membership ends (because you cancel or a payment fails), your live sites go offline straight away. Visitors see a notice that the site is unavailable, and its contact form stops working. If you subscribe again, they come back.
- It's your responsibility to tell the businesses whose sites you run before you cancel.
- 7 days after your membership ends, we delete your sites and your work in Site Hustle (leads, pitches, follow-ups and templates), including your clients' sites and their photos and messages. Your login stays, so you can come back and start again. Download or copy anything you need before then.
7. Sample sites and pitching businesses
Sample sites let you show a business what its website could look like before it hires you. You agree to use them honestly:
- Never say or suggest that you are the business, work for it, or have its approval when you don't.
- Only publish a site (make it live) for a business that has agreed to it.
- If a business asks you to stop or to remove its sample, do so straight away (use “Delete this site” in the editor's Go live tab).
- When you contact businesses, follow the laws that apply to you and to them, such as CAN-SPAM and the TCPA in the US, CASL in Canada, and GDPR and PECR in the UK and EU. You're responsible for the messages you send.
Sample sites are private preview links. They aren't listed on search engines, and they stop working after 30 days unless you publish them. Three days after that, they're deleted. Business details come from public listings (such as Google) and from you. Check them with the business, because they can be wrong or out of date.
Invoices to your clients. You can use Site Hustle to send invoices to your own clients. Payments go directly to you: through your own Stripe account (under Stripe's terms, which you agree to with Stripe), your own payment link, or however you and your client agree. Site Hustle doesn't receive, hold or send that money, and isn't part of the agreement between you and your client, so refunds, disputes and late payments are between you and them. You're responsible for any taxes on what you're paid.
8. Your content
- You keep ownership of what you add to Site Hustle: words, photos, logos and other material (“your content”). You let us store, show and process it only to run Site Hustle for you, including hosting your clients' sites.
- You must have the right to use everything you upload, such as a business's photos and logo, usually with the owner's permission.
- Stock photos come from Unsplash and are used under the Unsplash license, with credit to the photographer.
- Messages sent through a site's contact form belong to that business. We deliver them to the email set up for the site and keep a copy so they aren't lost.
9. AI features
- Site Hustle uses AI to write website text and pitches, and to make AI videos and the Launch & Growth Kit's pictures.
- AI can get things wrong. Check everything before you use it, especially facts, prices and claims about a business.
- AI videos are labeled as AI in the editor. Don't present them as real footage of a business.
10. Things you must not do
- Send spam, or use Site Hustle for anything illegal, misleading or harmful.
- Pretend to be someone else, or build sites that trick people (for example, phishing pages or fake businesses).
- Upload material you don't have the right to use, or that is hateful, sexually explicit or violent.
- Try to break, overload, copy or get around the limits of Site Hustle, or access other people's accounts.
If you do, we may remove content, take sites offline, or suspend or close your account.
11. Our service
We work hard to keep Site Hustle running smoothly, but we provide it “as is” and can't promise it will always be available or free of mistakes. Parts of it rely on other companies (such as Google, Stripe and our hosting provider), and we're not responsible for their services.
The referral program has its own referral terms.
12. Limits on our responsibility
To the extent the law allows, we're not responsible for indirect losses, such as lost profits, lost clients or lost data, and our total responsibility to you is limited to [liability limit, e.g. the amount you paid us in the 12 months before the claim].
You agree to cover us for claims from others that come from how you used Site Hustle, such as the messages you sent or content you uploaded without permission.
13. Changes to these terms
If we change these terms in an important way, we'll let you know by email or in the app before the change applies. If you keep using Site Hustle, the new terms apply.
14. Law and disputes
These terms are governed by the laws of New Jersey, and any dispute will be handled by the courts there, unless the law where you live says otherwise. If you have a problem, please contact us first. Most things can be sorted out quickly.
